Mythic Entertainment Sues Microsoft over Mythica |

There's <a href="http://www.worthplaying.com/article.php?sid=15208" target="_blank">news</a> at Worthplaying that reports Mythic Entertainment, makers of Dark Age of Camelot, has filed suit against Microsoft, developers of Mythica, over the similarities in the names:<blockquote><em>"We have worked hard for eight years to earn our reputation for producing high quality online games, including games that compete successfully with those offered by the biggest corporations in the world, such as Microsoft," Mark Jacobs, president and CEO of Mythic Entertainment, said. "The Mythic name and registered trademark are the symbols of that reputation and quality, and they represent the goodwill and recognition we have achieved in the computer game industry and among consumers worldwide."

<br>"We cannot allow Microsoft to usurp our rights, confuse the public, and use the Mythic brand to gain an unfair competitive advantage."

<br>The case, filed in the U.S. District Court for the Eastern District of Virginia, in Alexandria, alleges that Microsoft's forthcoming online game, "Mythica," and pre-release publicity for such game, infringes Mythic's name and federally-registered trademark MYTHIC ENTERTAINMENT(r), and amounts to unfair competition in violation of federal and state law. The complaint alleges that the term "Mythica" is so similar to Mythic's registered mark and name as to be likely to cause confusion, mistake or deception among consumers. Mythic is seeking a permanent injunction and economic remedies. Mythic Entertainment objected to Microsoft's use of "Mythica" previously, but Microsoft refused to stop using the name.</em></blockquote> |

I like DAoC.
I hate Microsoft.
I'm on Microsoft's side on this. (I can't believe I just typed that)
This similar name BS has got to stop. We're going to run out of names real fast here... but to be fair, if Mythic Entertainment can prove beyond a shadow of a doubt that they are the first company to have ever used the word Mythic, then I will take back what I said and back Mythic. Until then, too bad. Bandai isn't suing CBS right now (.hack//xxxxx, Hack the TV series). Because they have no case.

Look at the good that can come of this:
Microsoft is currently suing the Lindows company for Trademark Infringment. Now, they are being sued by Mythic for the same. Microsoft has to be wrong on one of these counts, and they can't (though they probably will) say that one is infringment and the other is fine.
Either they settle one case, or they are proven hypocrites. |

I change my mind. Mythic deserves to protect their companies name from the confusion caused by Microsoft's similarity in both project types (MMOs) and name sounds. Lindows was protested by Microsoft for good reason, and so should Mythica be renamed because it causes so much confusion and does irreparable harm to Mythic. Im backing Mythic on this and i hope they win the damn thing. Whether you like DAOC or not is immaterial. |

I disagree, Ammon.
Lindows is a deliberate and calculated attempt to leverage "Windows" for their own commercial uses - the product is a Linux distro aimed at the Windows market - and the name was chosen to convey this.
Mythic's game is "Dark Age of Camelot" - pretty hard to confuse that with "Mythica". Microsoft doesn't need to leverage Mythic's name - Microsoft is already immeasurably better known than Mythic and they already had significant MMO market share with Asheron's Call before Mythic ever came along.
I would suggest even Bungie's old strategy game "Myth" and sequels is better known than "Mythic Entertainment". _________________ Editor @ RPGDot |

I understand, good point. Also the MMO player community isnt stupid -- we know the difference between Mythic and Mythica. I think they are more worried about potential uninformed casual customers. But still, if they did adequate research into the genre they would know the difference. How many of us are uninformed casual customers? Hardly any. |

If Mythic is allowed this case, and granted i understand there point though i strongly disagree with it, then the courts will be granting permission to countless other similarity cases. Rules are Rules Period. if the game was called Mythic i might understand, but would still disagree because one is a company name and the other is a game. My name is Mike and i should have the right to sue anyone that has a business with Mike in the title, NO WAY i don't think so. It's a small world folks but there's room enough for all of us so put aside the EGO'S and understand it's just business and nothing personal. Personally i am apalled by Mythic's descision to go through with this and i certainly hope the courts use this case to make an example. _________________ Madigan, World Designer
