The problem is we don´t know
- what happens to JoWooD´s publishing rights. Do they fall back to PB or will they become available to the highest bidder?

JoWood's publishing rights are a company asset, and are treated as such by the bankruptcy court. They are protected, depending on the type bankruptcy they file, against lost of assets that could later keep the company solvent.
However PB has a contract with JW, and can have the courts release them from a contract that is in default, but it is time consuming and expensive if contested, which it surely would be. JW would never give up the rights to G3 if they can help it if they want to stay in business.
Depending on the contract between JW and PB, the rights may or may not be transferable.....meaning the rights might can be sold. The courts would use that money for JW debts, and PB would have a new pub. But I have no idea what the contract are....so your statement is very good....we don't know. JoWooD CEO Seidl is on record saying something like "in case of bankruptcy JoWooD would be out of business because the publishing rights would evaporate within seconds". He was asked if a bankruptcy could be a new beginning, like it often is in the German speaking countries.
Gothic could be a special case, though, because PB and/or JoWooD bought the franchise out of the Phenomedia ashes. _________________ Webmaster GothicDot |

As for G3, I still think it won't set back too much in any event. It has gotten much more PR than any previous Gothic game, and finding a new publisher should be possible.
I still hope JoWood gets through this though, as they've already made quite big plans for G3 I think, and would probably finance an add-on if they could. |

I hope they manage as well, especially since they have promised to use a more active publisher in the non-German speaking countries. When G2 was released, I saw no ads or anything for it, whatsoever. _________________

Complex situation. If
- the IP belongs exclusively to PB and
- the rights revert to PB if JoWooD goes belly up
a JoWooD bankruptcy would be ideal for PB. They suddenly would have everything and could negotiate with a new publisher, ideally with Koch because they´re already working on G3. _________________ Webmaster GothicDot |

but what about the English version of Gothic?
IIRC Jowood is the one that's helping with the english version of g3 localizations and such, aswell as helping it come out supposdly just 3 weeks from the german release.
Without jowood would it then fall back to how G1/G2 did with the english counterparts? |

Petition of Bankruptcy rejected
JoWooD Productions Software AG, listed on the Viennese stock market, announces:
The Landesgericht Leoben (superior court), which is the competent court for the petition of bankruptcy against JoWooD Productions Software AG, Technologiepark 4a, A-8786 Rottenmann, Österreich introduced by Perception PTY LTD, Suite 3, 61 Dunning Avenue Roseberry NSW, AU-2019 Australia, has decided by order, that the bankruptcy proceedings be rejected.
The court order also states that Perception itself has admitted that the delay of the game delivery was also caused by the failure of Perception although JoWooD has already paid the undisputable amount of EUR 5.5 Mio.
JoWooD will now continue its successful way of restructuring the company.

Yup, but PB will still make games after G3, and it would be nice if JoWood would continue to back them up in future projects. |
