Glitch/bug, what have you.....
   

I noticed a rather lame glitch, im not sure what may have triggered it but in the town that starts the quest for the EB artifact (forget name but nords live in it) I was able to steal anything right in front of the townsfolk and all they said was stop theif, dont try to escape, etc.... but my faction never went down, i never got a bounty on my head, and nobody tried to fight me. I found this quite irritating since it kinda took away from the realism aspect. But they only way I can seem to get around it is to slap my hand every time i see it sneaking towards that enchanted robe or ring that i know i can get away with taking . Damn I hate temptation.
