When you've learned pickpocketing and your dexterity skill is above 60, you can also steal the evidence.

Or you can do like a friend of mine who was a militia: just kick his but  That's the way of the merc not of a paladin. i did the opposite. I was a merc but took the Paladin way and talked him to annoynce
