As long as he doesn't say "I can't do that.", "It's impossible.", or "That's too difficult for me." the lock is pickable with your current level of Technical Skill.

As for the tools being damaged, as far as I could tell the quality of the tools does not matter. I have picked several locks in a row with a tool kit that only had 1 durability left. To avoid damaging your tools you need to raise your Technical skill. For example, it might take 50 Technical Skill to pick a plain wooden door. If you had 50 Technical Skill you could pick the lock on the door, but you would damage your tools. If you had 55 Technical Skill you would not damage your tools as much. If you had 60 Technical Skill you probably would not damage your tools at all. Which is why I was able to pick several locks with my tool kit that only had 1 durability left. If you need a few extra points just enchant a weapon with garlic for extra dexterity and/or cast the bless spell. When I start damaging my tools I use the Bless spell. This usually stops me from damaging my tools, but it does not guarentee that I will pick the lock on the first attempt.

When I finish the game I will post a list of the types of chests and doors that can be picked at each level of Technical Skill.
